Le Resort & Villas (the “Company”) values you as our guest and recognizes that privacy is important to you. We are committed to maintaining robust privacy protections regarding your Personal and Other Data (collectively, “Data”) in accordance with the Personal Data Protection Act (PDPA), B.E. 2019. Our Privacy Policy (“Privacy Policy”) is designed to help you understand how we collect, use and safeguard the information you provide to us and to assist you in making informed decisions when using our Service.
For purposes of this Agreement, “Site” refers to the Company’s website, which can be accessed at [Leresort.com]. Other mobile and social media applications will be referred to as “Platform”, which allow you to search for, visit, use the products and services of the Company and/or its business partners such as:
- Residential projects, i.e. Loft villas, Pool villas, Commercial buildings and other projects.
- News and promotions of products and services.
- Any operation regarding products and services.
The terms “we,” “us,” and “our” refer to the Company.
“You” refers to you, as a user of our Site or our Service.
By accessing our Site or our Service, you accept our Privacy Policy and Terms of Use (found here: [insert link to Terms of Use (Leresort.com/terms-of-use)]), and you consent to our collection, storage, use and disclosure of your Personal Information as described in this Privacy Policy.
This Privacy Policy describes the privacy practices of Le resort & Villas for data that we collect:
- through websites operated by us from which you are accessing this Privacy Policy, including Leresort.com and other websites owned or controlled by the M Pool Villa Resort Group (collectively, the Websites);
- through our social media pages that we control from which you are accessing this Privacy Policy (collectively, our Social Media Pages);
- through email messages that we send you that link to this Privacy Policy and through your communications with us online or in person;
- from third parties such as Authorized Licensees, Owners and Franchisees, and Other Sources, such as public databases, marketing partners and other third parties; and ● when you visit or stay as a guest at one of our properties, or at homes and villas offered on the M Property Management by M Pool Villa Resort Group, or through other offline interactions (collectively, Property Visits and Offline Interactions).
Collectively, we refer to the Websites, and our Social Media Pages, as the “Online Services” and, together with the Property Visits and Offline Interactions, the “Services.”
- INFORMATION WE COLLECT
We collect “Non-Personal Information” and “Personal Information.” Non-Personal Information includes information that cannot be used to personally identify you, such as anonymous usage data, general demographic information we may collect, referring/exit pages and URLs, platform types, preferences you submit and preferences that are generated based on the data you submit and number of clicks. Personal Information we collect includes the following categories:
- Identifiers, such as name, nationality, passport, visa or other government-issued identification data, and online identifiers;
- Personal information, as defined in the Thailand Hotel Act, B.E. 2547 (2004), such as name, contact information, and financial information;
- Characteristics of protected classifications under Personal Data Protection Act (PDPA), B.E. 2019, such as gender, age, medical conditions, primary language, national origin, citizenship, and marital status;
- Commercial information, such as transaction information, purchase history, financial details, payment methods, and membership or loyalty program data.
In more limited circumstances Le Resort & Villas may also collect the following categories of Personal Information:
- Data about family members and companions, names, and ages of children F. Biometric data
- Audio, electronic, visual and similar information, such as images and audio, video or call recordings created in connection with our business activities or via security cameras located in public areas, such as hallways and lobbies, in our properties;
- Internet or network activity information, such as browsing history and interactions with our and other websites and computer systems;
- Geolocation data, such as device location and IP location;
- J. Inferences drawn from any of the Personal Information listed above to create a profile or summary about, for example, an individual’s preferences and
We may also collect information about your Preferences that we use to make your current and future stays and experience with us more enjoyable, including information about your interests and other relevant information that we learn about you during your stay. This may also include any likes and dislikes about our services that you tell us about so that we can improve our services, and specific dietary, health restrictions or personal needs to ensure your wellbeing. We may also collect your “Personal Preferences,” that may include details of your special anniversaries (such as your birthday or wedding anniversary), what type of activities you prefer to take part in when staying with us, and your hobbies. Personal Preferences may also include details about who you usually travel with, their relationship to you, and your marital status.
If you submit any Personal Data about other people to us or our Service Providers (e.g., if you make a reservation for another individual), you represent that you have the authority to do so and you permit us to use the data in accordance with this Privacy Policy.
Le Resort & Villas acquires this information directly from you, which may be submitted to us through the registration or booking process at the Site (Online) or Le Resort & Villas property (Offline).
- Information collected via Technology
To activate the Service you do not need to submit any Personal Information other than required by the Thailand Hotel Act, B.E. 2547 (2004). To use the Service thereafter, you do need to submit further Personal Information Identifiers, which may include name, nationality, passport, visa or other government-issued identification data, and online identifiers. However, in an effort to improve the quality of the Service, we track information provided to us by your browser or by our software application when you view or use the Service, such as the website you came from (known as the “referring URL”), the type of browser you use, the device from which you connected to the Service, the time and date of access, and other information that does not personally identify you. We track this information using cookies, or small text files which include an anonymous unique identifier. Cookies are sent to a user’s browser from our servers and are stored on the user’s computer hard drive. Sending a cookie to a user’s browser enables us to collect Non-Personal information about that user and keep a record of the user’s preferences when utilizing our services, both on an individual and aggregate basis. The Company may use both persistent and session cookies; persistent cookies remain on your computer after you close your session and until you delete them, while session cookies expire when you close your browser. For example, the Company may use cookies to collect the following information:
- browser type, time spent on the Online Services, pages visited, referring URL, language preferences, and other aggregated traffic data.

- How and where we collect your data
This Privacy Statement describes the privacy practices of the M Pool Villa Resort Group for Personal and Other Data that we collect through the following:
- M Pool Villa Resort Group. We collect Personal Data and Other Data from other companies within the M Pool Villa Resort Group for the purposes described in this Privacy Statement, such as providing and personalizing the Services,
communicating with you, facilitating the loyalty programs and to accomplish our business purposes.
- M Property Management. We collect Personal Data and Other Data from companies and their service providers who manage Homes and Villas properties, your booking of Homes and Villas, and provide additional support to you during your stay at Homes and Villas (“M Property Management”). M Property Management is connected with the M Pool Villa Resort Group.
- On-Property and/or Travel Providers. We may collect your Personal Data and Other Data from spa, restaurant, health club, concierge, and other outlets at our properties. ● Promotional Activity. We collect Personal Data and Other Data from third parties who may provide promotions to you, such as Agoda, We Travel Together, or other offers.
- Other Sources & Service Providers. We collect Personal Data and Other Data from various third parties, such as public databases, joint marketing partners and online travel agencies (OTAs).
- Online Services. We collect Personal or Other Data when you interact with our Online Services, by performing such actions as, but not limited to, browsing, making a reservation, purchasing goods and services from our Websites or Social Media Pages, communicating with us or otherwise connecting with us or posting to social media pages, or signing up for a newsletter or participating in a survey, contest or promotional offer.
- Customer Care Centers. We collect Personal Data when you make a reservation over the phone, communicate with us by email, fax, or via online chat services or contact customer service. These communications may be recorded for purposes of quality assurance and training.
- Internet-Connected Devices. We collect Personal and Other Data from internet-connected devices available in our properties. For example, when you connect a device to the hotel’s internet, or when a smart home assistant may be available for your use to tailor your accommodations and experience.
- Children’s Privacy
The Site and the Service are not directed to anyone under the age stipulated by law (the “Age Limit”). The Site does not knowingly collect or solicit information from anyone under the Age Limit, or allow anyone under the Age Limit to sign up for the Service. In the event that we learn that we have gathered personal information from anyone under the Age Limit without the consent of a parent or guardian, we will delete that information as soon as possible. - HOW WE USE AND SHARE INFORMATION
Personal Information:
Except as otherwise stated in this Privacy Policy, we do not sell, trade, rent or otherwise share for marketing purposes your Personal Information with third parties without your consent. We do share Personal Information with vendors who are performing services for the Company, such as the servers for our email communications who are provided access to the user’s email address for purposes of sending emails from us. Those vendors use your Personal Information only at our direction and in accordance with our Privacy Policy.
In general, the Personal Information you provide to us is used to help us operate, manage, and maintain our business, to provide our products and services. For example, we use Personal Information to develop, improve, and maintain our products and services; contact users in response to questions, solicit feedback from users, provide technical support; personalize, advertise, and market our products and services to inform users about promotional offers; maintain our facilities and infrastructure; undertake quality and safety assurance measures; conduct risk and security control and monitoring; detect and prevent fraud; perform identity verification; perform accounting, audit, and other internal functions, such as internal investigations; comply with law, legal process, and internal policies; maintain records; and exercise and defend legal claims.

Non-Personal Information:
In general, we use Non-Personal Information to help us improve the Service and customize the user experience. We also aggregate Non-Personal Information in order to track trends and analyze use patterns on the Site. This Privacy Policy does not limit in any way our use or disclosure of Non-Personal Information and we reserve the right to use and disclose such Non-Personal Information to our partners, advertisers and other third parties at our discretion.
In the event we undergo a business transaction such as a merger, acquisition by another company, or sale of all or a portion of our assets, your Personal Information may be among the assets transferred. You acknowledge and consent that such transfers may occur and are permitted by this Privacy Policy, and that any acquirer of our assets may continue to process your Personal Information as set forth in this Privacy Policy. At M Pool Villa Resort, we believe that you should have choices with respect to your data. We provide you with the options, information, and choices below to express your preferences: what and how much you share with us and when and how you hear from us. Please note that notwithstanding the promotional preferences you indicate by either unsubscribing or opting out on the communication channels, we may continue to send you administrative messages including, for example, information about your reservations or stays, including confirmation and pre-arrival emails, or periodic updates to our Privacy Policy.
The Company will retain your Personal Data only for such period of time as necessary to fulfill the purposes outlined in this Privacy Policy. If you would like to request to access, change, delete, restrict the use of, or object to the processing of your Personal Data that you have previously provided to us, please contact [info@leresort.com]. For your protection, we only fulfill requests for the Personal Data associated with the email address that you identify in your request, and we may need to verify your identity before fulfilling certain requests. M Pool Villa Resort acknowledges and respects our guests’ privacy and we will try to comply with your request as soon as reasonably practicable and consistent with applicable law.
- LINKS TO OTHER WEBSITES
As part of the Service, we may provide links to or compatibility with other websites or applications. However, we are not responsible for the privacy practices employed by those websites or the information or content they contain. This Privacy Policy applies solely to information collected by us through the Site and the Service. Therefore, this Privacy Policy does not apply to your use of a third party website accessed by selecting a link on our Site or via our Service. To the extent that you access or use the Service through or on another website or application, then the privacy policy of that other website or application will apply to your access or use of that site or application. - CHANGES TO OUR PRIVACY POLICY
The Company reserves the right to change this policy and our Terms of Service at any time.
